1. Purpose and acceptance

These Terms govern use of the Palmdrive website, account, listings, forms, and rental-agreement tools (the “Platform”). They form an agreement between Palmdrive LLC (“Palmdrive”, “we”, the “Operator”) and the User regarding the Platform itself.

You accept these Terms when you expressly confirm acceptance, create or use an account, publish a listing, or use another function that clearly refers to them. If you do not accept them, do not use that function. Viewing a public page without using an interactive function does not by itself create a vehicle-rental agreement.

2. Not a public vehicle-rental offer

Listings, indicative prices, availability, calculations, and invitations to send an enquiry are information and invitations to negotiate. They are not a public offer by Palmdrive to rent every displayed vehicle and do not contain all final terms of a particular rental.

Each rental is governed by a separate Rental Agreement identifying the vehicle, Renter, owner or lessor, period, price, deposit, insurance conditions, and other applicable terms. That agreement prevails over these Terms for the rental itself.

3. Platform role and rental parties

Palmdrive provides tools to publish and find vehicle listings, contact Partners, manage accounts, and prepare, accept, store, or display Rental Agreements. The vehicle owner or lessor is the person expressly identified in the relevant Rental Agreement. Palmdrive is a party to a rental only if the Operator is named there as owner or lessor.

An independent Partner is responsible for its authority to rent the vehicle, licences, registration, insurance, condition, availability, description, pricing, and performance. The Renter must review the vehicle and Rental Agreement before acceptance and provide accurate information and legally required documents.

4. Accounts and access

Access may be confirmed by a one-time code sent to the email address or phone number provided by the User. The User must control that mailbox or number, keep access secure, provide accurate information, and promptly report suspected unauthorised access.

Users must not impersonate others, submit fraudulent or misleading information, bypass security, interfere with the Platform, scrape it without permission, distribute malicious code, or use it unlawfully.

5. Partner obligations and listings

A Partner must:

publish accurate, current, complete, and non-misleading information;
have the legal right and authority to offer every listed vehicle;
disclose material rental restrictions, deposits, mileage, insurance, delivery, and additional charges before acceptance;
use only content it is entitled to publish and respect privacy and intellectual-property rights;
comply with Thai licensing, registration, tax, insurance, consumer, and other requirements applicable to its activity.

We may review, suspend, or remove content or access where reasonably necessary for safety, security, legal compliance, or a material breach.

6. Enquiries, reservations, prices, and payments

Sending an enquiry does not guarantee a reservation. Displayed prices are normally in Thai baht and remain indicative until the rental parties confirm the final vehicle, period, price, deposit, insurance, delivery, and other material terms in the Rental Agreement.

Unless a specific Platform screen expressly states otherwise, payments, deposits, refunds, and settlements are handled directly between the Renter and the relevant owner or lessor. Users must verify the recipient and payment terms. Palmdrive is not responsible for unauthorised transfers made outside a Platform payment function.

7. Electronic records and Rental Agreements

The Platform may record the User’s confirmation, timestamp, account, session, agreement snapshot, and generated PDF. The parties agree that electronic records and confirmations may be used as evidence to the extent permitted by applicable law. A Rental Agreement is concluded only through the acceptance process stated for that agreement.

8. Vehicle use and safety

The Renter must have the licence, age, experience, and documents required by law and the Rental Agreement; follow traffic and safety rules; use the vehicle only in permitted places and conditions; and comply with accident, breakdown, damage, fine, fuel, and return procedures in that agreement.

9. Content and intellectual property

The Platform software, interface, branding, and original materials are protected by applicable law. A User retains rights to uploaded content but grants Palmdrive a non-exclusive, worldwide, royalty-free right to host, reproduce, resize, adapt for technical formats, display, and transmit that content as necessary to operate and promote the Platform and the relevant listing. The licence ends when the content is removed, except for backups, evidence, and materials lawfully retained for legal purposes.

10. Privacy

Personal data is processed under the Privacy Notice and Personal Data Processing Policy. Acknowledging that notice is not consent. Where consent is legally required, it must be requested separately. A User providing another person’s data must have a lawful basis and provide required notice.

11. Availability and responsibility

We take reasonable steps to keep the Platform available and secure but do not guarantee uninterrupted access, error-free third-party information, or availability of a particular vehicle. Maintenance, network failures, external providers, and force majeure may affect operation.

To the extent permitted by mandatory law, Palmdrive is not responsible for acts of independent Partners or Renters, vehicle condition, accidents, fines, insurance decisions, or off-Platform payments. Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.

12. Suspension and termination

A User may stop using the Platform at any time. We may restrict access where reasonably necessary for security, maintenance, legal compliance, investigation of abuse, or a material breach. Existing Rental Agreements, payment duties, evidence, intellectual-property provisions, and lawful data retention are not cancelled solely by account closure.

13. Governing law, disputes, and changes

These Terms are governed by the laws of the Kingdom of Thailand. The parties should first try to resolve a dispute by good-faith correspondence. Thai courts have jurisdiction unless mandatory applicable law provides otherwise. A consumer is not deprived of mandatory protections available under the law that applies to that consumer.

We may update these Terms for future use of the Platform. Material changes are published at this address with a new update date. Changes do not rewrite an already concluded Rental Agreement unless its parties lawfully agree otherwise.
